Allgemeine Geschäftsbedingungen (Kurzform)
  • Vorauszahlung bei Bestellungen unter 25 € erforderlich.
  • Das Produkt wird ausschließlich digital geliefert.
  • Nach erfolgter Lieferung übernimmt die anbietende Person keine Verantwortung für Verlust oder Beschädigung des Produkts.
  • Die auftraggebende Person hat Anspruch auf bis zu zwei (2) vollständige Überarbeitungen in der Skizzenphase.
  • Nach Fertigstellung sind angemessene kleinere Änderungen erlaubt (z. B. Änderung der Augenfarbe).
  • Die Bezahlung muss in Euro (€) erfolgen.
  • Ein Teil-Rückerstattungsantrag ist möglich, wenn innerhalb von vier (4) Wochen kein Fortschritt erfolgt ist oder wenn das Produkt nicht innerhalb von zwei (2) Monaten abgeschlossen wurde.
  • Die auftraggebende Person verpflichtet sich zu einer zügigen und verlässlichen Kommunikation mit der anbietenden Person.
  • Das Produkt darf ohne zusätzliche Lizenzvereinbarung nicht kommerziell genutzt werden.
  • Die anbietende Person behält sich das Recht vor, Bestellungen jederzeit zu stornieren und bereits geleistete Zahlungen zurückzuerstatten.
  • Die auftraggebende Person ist nicht berechtigt, das Produkt in blockchainbezogenen Technologien zu verwenden, einschließlich NFTs, Kryptowährungen oder zukünftiger Entwicklungen in diesem Bereich.
  • Die auftraggebende Person ist nicht berechtigt, das Produkt in KI-bezogenen Technologien zu verwenden, einschließlich der Nutzung in Datensätzen, Trainingssystemen oder zukünftigen Entwicklungen in diesem Bereich.

Mit der Bestellung eines Produkts bei der Anbietenden erklärt sich die Auftraggebende mit den folgenden Bedingungen einverstanden:

ZAHLUNGEN

1. Die Auftraggebende erklärt sich damit einverstanden, den vollständigen Betrag im Voraus zu bezahlen, wenn der Auftragswert unter oder gleich 25 € liegt.

2. Bei einem Auftragswert über 25 € verpflichtet sich die Auftraggebende, 50 % des Rechnungsbetrags im Voraus zu zahlen. Die restlichen 50 % sind nach Freigabe der Skizze fällig.

3. Andere Zahlungspläne müssen im Voraus einvernehmlich vereinbart werden, bevor die Arbeit am Produkt beginnt.

4. Die Anbietende beginnt erst mit der Arbeit, wenn die vereinbarte Zahlung eingegangen ist.

5. Bei bestimmten Auftragsarten ist keine Ratenzahlung möglich. In diesem Fall wird die Auftraggebende darüber informiert und es wird ein alternativer Zahlungsplan vereinbart.

LIEFERUNG

6. Das Produkt wird nach Eingang der vollständigen Zahlung digital an die von der Auftraggebenden angegebene E-Mail-Adresse übermittelt.

7. Abweichende Lieferarten (digital oder physisch) müssen im Voraus vereinbart werden. Dabei trägt die Auftraggebende alle anfallenden Zusatzkosten.

8. Die Auftraggebende ist verantwortlich dafür, eine geeignete Liefermethode vorzuschlagen. Die Anbietende haftet nicht für technische Probleme wie Spamfilter oder Dateiverlust nach der Auslieferung.

9. Nach der Lieferung ist die Auftraggebende selbst für die sichere Speicherung des Produkts verantwortlich. Ein Verlust aufgrund von Fahrlässigkeit wird nicht ersetzt. Es besteht kein Anspruch auf eine erneute Zusendung oder Sicherung durch die Anbietende.

ÜBERARBEITUNGEN

10. Die Auftraggebende hat Anspruch auf zwei (2) vollständige Überarbeitungen in der Skizzenphase.

11. Nach Fertigstellung sind kleinere Änderungen (z. B. Augenfarbe) in angemessenem Umfang erlaubt, bis maximal 10 % der ursprünglichen Arbeitszeit. Darüber hinaus gehende Änderungen erfordern eine zusätzliche Vereinbarung und gesonderte Vergütung.

WÄHRUNG

12. Die Zahlung hat in EURO (€) zu erfolgen.

13. Die Auftraggebende trägt alle anfallenden Kosten für Währungsumrechnung, Banküberweisungen oder Gebühren von Zahlungsanbietern.

14. Eine Zahlung gilt erst als abgeschlossen, wenn der vollständige Betrag in EURO (€) auf dem Konto der Anbietenden eingegangen ist.

RÜCKERSTATTUNG

15. Die Auftraggebende hat das Recht auf eine Rückerstattung (Höhe der Rückerstattung ist basierend auf Projektfortschritt), wenn über vier (4) Wochen hinweg kein Fortschritt erfolgt ist oder das Produkt nicht innerhalb von zwei (2) Monaten fertiggestellt wurde. Bei größeren Projekten müssen gesonderte Rückerstattungsbedingungen vorab vereinbart werden. Unvorhergesehene Unterbrechungen wie Krankheit oder Unfälle sind hiervon ausgenommen, sofern diese glaubhaft dokumentiert werden.

16. Die Auftraggebende verpflichtet sich, zügig auf Rückfragen zu reagieren. Ausbleibende Rückmeldungen gelten als stillschweigende Zustimmung zum bisherigen Arbeitsstand.

17. Bei Überbezahlung von Seiten des Auftraggebenden, ist eine Rückzahlung dieses Betrages nicht möglich, um den Künstler vor Betrugsmaschen zu schützen!

NUTZUNGSRECHTE

18. Das Produkt ist ausschließlich für den privaten Gebrauch bestimmt.

19. Eine kommerzielle Nutzung (z. B. Weiterverkauf, Veröffentlichung, Reproduktion) erfordert eine gesonderte Vereinbarung mit entsprechender 

Vergütung.

20. Die Auftraggebende hat kein Recht, das Produkt in blockchainbezogenen Technologien zu nutzen, einschließlich NFTs, Kryptowährungen oder vergleichbaren zukünftigen Entwicklungen.

21. Ebenso ist es untersagt, das Produkt für KI-Datensätze, KI-Tools oder ähnliche Technologien zu verwenden – auch nicht für zukünftige Entwicklungen.

STORNIERUNG

22. Die Anbietende behält sich das Recht vor, jederzeit einen Auftrag ohne Angabe von Gründen zu stornieren. In diesem Fall erfolgt eine vollständige 

Rückerstattung.

23. Unhöfliches oder respektloses Verhalten kann zur Stornierung führen. Die Rückzahlung erfolgt anteilig je nach Fortschritt der Arbeit. Die Anbietende behält sich das Recht vor, zukünftige Aufträge der betreffenden Person abzulehnen.

Terms of Service (shortinfo)
  • Pay up front for orders below 25€.
  • Product will be delivered digitally.
  • Seller will not be responsible for loss of product once it has been delivered.
  • Customer has right to two (2) complete revisions in the sketching phase.
  • Customer has right to reasonable amounts of minor edits after completion (I.E eyecolour change)
  • Must be paid in EURO (€)
  • Customer can ask for a refund on orders with no progress for four weeks (4), or when work has not been completed within two month (2)
  • Customer is required to contact the seller in a fast and responsive manner.
  • Products cannot be used for commercial use without additional fees.
  • Seller can cancel and refund any order at any time.
  • Customer does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.
  • Customer does not hold the right to use the product in any AI-related technology, including submitting for datasets, and any future inventions in the space

By ordering Product from the Seller the Customer agrees to the following terms and conditions:

PAYMENTS
1. Customer agrees to pay the due amount upfront for any orders of value lower or equal to 25 €.
 
2. On orders above 25 € customer agrees to pay half the invoice total upfront. The other half has to be paid on approval of the initial sketch.
 
3. Any other payment schedule has to be mutually agreed before work on the Product commences.
 
4. Customer accepts that work on the Product will not commence until payment has been received by Seller according to the above schedule.
 
5. Certain types of work do not allow for a split payment. In such cases customer will be informed about this and will be asked to agree on a different payment schedule, before any work can commence.
 
PRODUCT DELIVERY
6. Customer agrees that Product will be delivered digitally to email address provided by Customer, after the final payment has been received by the Seller.
 
7. Any other method of delivery, either digital or physical, has to be mutually agreed before the work commences. Customer is obliged to bear any costs incurred by alternative delivery method, such as postal costs, material costs, digital service subscription fees etc.
 
8. It is sole responsibility of Customer to propose delivery method which works for both parties. Seller cannot be held accountable for Customer‘s loss of access to the delivery method, loss of delivered files, impediments such as spam filters or any other technical obstacles outside responsibility of the Seller.
 
9. Upon delivery of the product, it is the Customer‘s responsibility to store it properly. Loss of product due to negligence will not be reimbursed by the Seller. Seller can not guarantee that the original copy of the product will be available in the case that the Customer lost their files.
 
REVISIONS
10. Customer has the right to two (2) complete revisions in the sketching phase.
 
11. Customer has right to a reasonable amount of minor edits after completion, such as changing an eyecolour or fixing a small detail, up to an additional 10% of the total time spent on creating the originally delivered Product. Any requests above that, however minor, will require a prior mutual agreement and will result in a  proportional increase of order value. Any such increase will be invoiced separately. Work on any such excessive requests will not commence until the payment for the additional invoice(s) has been received.
 
CURRENCY CONVERSIONS
12. Customer agrees to pay the total amount specified in EURO (€)
 
13. It is the sole responsibility of Customer to bear any currency conversion costs, bank transfer fees, payment provider service fees and any other costs involved in transferring funds to the Seller.
 
14. Payment is considered as received and completed only when total amount received on Seller‘s Bank/Paypal account is equal to the invoice amount in EURO (€)
 
REFUND POLICY
15. Customer has right to request a refund (Amount of refund is based on project progress) if there‘s been no progress for four (4) consecutive weeks, or when Product has not been completed within two (2) months. Refund conditions for commissions which require more work must be agreed separately, before the work commences. 
These provisions exclude work interruptions caused by unforeseen circumstances such as illness, accident or any other credibly documented reason for interruption of work.
 
16. Customer obliges to contact the Seller in a fast and responsive manner, responding swiftly to any requests for comments, clarifications, opinions, validation of progress etc. Lack of timely communication on behalf of Customer will be recognized as implicit approval of all work progress and current state of the Product.
 
17. In case of overpayment by the client, a refund of this amount is not possible in order to protect the artist from fraud!
 
PERSONAL AND COMMERCIAL USE
18. The Product received by Customer is for personal use. 
 
19. Any use of the Product for commercial purposes, reselling it, reproduction or publishing for reasons other than personal purposes has to be approved beforehand by the Seller. This will require a separate agreement between Customer and Seller defining exact conditions and financial implications of such use of the Product.
 
20. Customer does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.
 
21. In addition, Customer does not hold the right to use the product for AI datasets or for AI tools and any present or future inventions in the space.
 
CANCELLATIONS
22. Seller reserves every right to refuse or cancel any order, under condition of full refund, without giving reasons to Customer.
 
23. Any disrespectful behaviour will not be tolerated and may result in a cancellation of the order. Customer will receive full or partial refund depending on amount of work completed. Seller will have full right to refuse any service to the Customer in the future.
